    Ethical Considerations When School Discipline and Juvenile Justice Overlap

    Students with disabilities are at greater risk of being pulled into the school-to-prison pipeline and can suffer more from its effects.  Students with disabilities are suspended or expelled for behaviors that are a direct result of their disabilities.  Sometimes those students are referred directly to the juvenile justice system for the same conduct.  Sometimes court involvement comes later--children who are separated from school more frequently end up in the juvenile justice system down the line.  And seventy percent of children in the juvenile justice system have educational disabilities.  Frequently, though, the prosecutors, juvenile probation officers, and judges in the juvenile system are not informed about a student's disabilities and the role(s) it may have played in her or his conduct.  This panel explores these problems--and the ethical concerns that confronting it raises for lawyers representing students and districts.
